  根據(jù)國(guó)家有關(guān)法律、法規(guī)和本市有關(guān)規(guī)定,甲、乙雙方在平等自愿的基礎(chǔ)上,經(jīng)友好協(xié)商,就甲方將其合法擁有的房屋出租給乙方使用,乙方承租使用甲方房屋事宜,訂立本合同。 Party A and B have reached an agreement through friendly consultation to conclude the following contract.

  1、房屋地址Location of the premises

  甲方將其所有的位于 的房屋及其附屬設(shè)施在良好狀態(tài)下出租給乙方作_______使用。

  Party A will lease to Party B the premises and attached facilities owned by itself, which is located at__________________________________________on for _________

  2、房屋面積Size of the premises

  4、租金Rental

  5、押金Deposit

  1)、為確保房屋及其附屬設(shè)施之安全與完好,及租賃期內(nèi)相關(guān)費(fèi)用之如期結(jié)算,乙方同意于

  ______年_____月 日前支付給甲方押金 元整,甲方在收到押金后予以書面簽收。

  2)、Guarantying the safety and good conditions of the premises and attached facilities and account of relevant fees are settled on schedule during the lease term, party B will pay_____________________

  to party A as a deposit before________(month)_________ (day)_________ (year). Party A will issue a written receipt after receiving the deposit.

  2)、除合同另有約定外,甲方應(yīng)于租賃關(guān)系解除或者在合同解除日且乙方點(diǎn)清并付清所有應(yīng)付費(fèi)用后搬出的當(dāng)天將押金全額無(wú)息退還乙方。

  Unless otherwise provided for by this contract, Party A will return full amount of the deposit without interest on the day when this contract expires or on the day when this contract is cancelled.and party B clears the premises and has paid all due rental and other expenses.

  3)、因乙方違反本合同的規(guī)定而產(chǎn)生的違約金、損壞賠償金和其它相關(guān)費(fèi)用,甲方可在押金中抵扣,不足部分乙方必須在接到甲方付款通知后十日內(nèi)補(bǔ)足。

  In case party B breaches this contract, party A has right to deduct the default fine, compensation for damage or any other expenses from the deposit. In case the deposit is not sufficient to cover such items, Party B should pay the insufficiency within ten days after receiving the written notice of payment from Party A.

  4)、因甲方原因?qū)е乱曳綗o(wú)法在租賃期內(nèi)正常租用該物業(yè),甲方應(yīng)立即全額無(wú)息退還押金給乙方,且乙方有權(quán)追究甲方的違約責(zé)任。并且甲方需要適當(dāng)?shù)闹Ц兑曳奖匾膿p失。

  If Party B can’t normally use the apartment because of Party A , Party A should return the deposit to Party B at once. And,Party A should pay the reasonable compensation required by Party B.

  6、甲方義務(wù)Obligations of Party A

  .1)、甲方須按時(shí)將房屋及附屬設(shè)施(詳見附件)交付乙方使用。

  Party A will provide the premises and attached facilities (see the appendix of furniture list for detail) on schedule to Party B for using.

  2)、房屋設(shè)施如因質(zhì)量原因、自然損耗、不可抗力或意外事件而受到損壞,甲方有修繕并承擔(dān)相關(guān)費(fèi)用的責(zé)任。如甲方未在兩周內(nèi)修復(fù)該損壞物,以致乙方無(wú)法正常使用房屋設(shè)施,乙方有權(quán)終止該合約,并要求退還押金。

  In case the premise and attached facilities are damaged by quality problems, natural damages or accidents, Party A will be responsible to repair and pay the relevant expenses. If Party A can’t repair the damaged facilities in two weeks so that Party B can’t use the facilities normally, Party B has the right to terminate the contract and Party A must return the deposit.

  3)、甲方應(yīng)確保出租的房屋享有出租的權(quán)利,如租賃期內(nèi)該房屋發(fā)生所有權(quán)全部或部分轉(zhuǎn)移、設(shè)定他項(xiàng)物權(quán)或其他影響乙方權(quán)益的事件,甲方應(yīng)保證所有權(quán)人、他項(xiàng)權(quán)利人或其他影響乙方權(quán)益的第三者能繼續(xù)遵守本合同所有條款,反之如乙方權(quán)益因此遭受損害,甲方應(yīng)負(fù)賠償責(zé)任。

  Party A will guarantee the lease right of the premises. In case of occurrence of ownership transfer

  in whole or in part and other accidents affecting the right of lease by party B, party A shall guarantee that the new owner and other associated, third parties shall be bound by the terms of this contract. Otherwise, Party A will be responsible to compensate party B’s losses.

  7、乙方義務(wù)Obligations of Party B

  1)、乙方應(yīng)按合同的規(guī)定按時(shí)支付租金及押金。

  Party B will pay the rental and the deposit on time.

  2)、乙方經(jīng)甲方同意,可在房屋內(nèi)添置設(shè)備。租賃期滿后,乙方將添置的設(shè)備搬走,并保證不影響房屋的完好及正常使用。

  Party B may add new facilities with Party A’s approval. When this contract expires, Party B may take away the added facilities without changing the good conditions of the premises for normal use.

  3)、未經(jīng)甲方同意,乙方不得將承租的房屋轉(zhuǎn)租或分租。

  Party B will not transfer the lease of the premises or sub without Party A’s approval.

  4)、乙方應(yīng)按本合同規(guī)定合法使用該房屋,不得擅自改變使用性質(zhì)。乙方不得在該房屋內(nèi)存放危險(xiǎn)物品。否則,如該房屋及附屬設(shè)施因此受損,乙方應(yīng)承擔(dān)全部責(zé)任。

  Party B will use the premises lawfully according to this contract without changing the nature of the premises and storing hazardous materials in it. Otherwise, Party B will be responsible for the damages caused by it.

  5)、乙方應(yīng)承擔(dān)租賃期內(nèi)的水、電、煤氣、電話費(fèi)、寬帶費(fèi)、物業(yè)管理費(fèi)和電視費(fèi)等一切因?qū)嶋H使用而產(chǎn)生的費(fèi)用,并按單如期繳納。

  Party B will bear the cost of utilities such as telephone communications, water, electricity, Gas,management fees,internet and cable television on time during the lease term.

  6)、乙方應(yīng)愛護(hù)租用的房屋及其設(shè)備,嚴(yán)格按專門的使用要求使用,如因乙方人為使用不當(dāng)而導(dǎo)致?lián)p壞,乙方負(fù)責(zé)賠償及修復(fù)費(fèi)用,乙方必須做到:

  Party B must take care of the property and its contents, and use them exactly according to the specific instructions; otherwise Party B should pay for the compensation and repairing fees to Party A for its improper use of the property. Party B must do as follows:

  6.1 足夠經(jīng)常清潔房屋,復(fù)合地板、木地板、地毯、瓷磚地面要按不同要求清潔;

  Do regularly clean the house. Clean the laminate floor, the parquet floor, the carpet, and the tile correctly according to the specific instructions.

  6.2足夠經(jīng)常通風(fēng)、開足空調(diào)(特別是在雨季、冬天)以避免冷凝水損壞房屋,導(dǎo)致霉變; Do regularly open the window and ventilate with the air conditioner (especially in rainy season and winter) in the house, in order to prevent the condensation water from damaging the house and going mouldy.

  6.3 足夠經(jīng)常清潔廚房、爐灶等電器;

  Keep the kitchen clean, such as electric apparatuses.

  6.4 浴缸、沖淋房、洗菜盆的排水口必須使用專門的濾網(wǎng)阻止頭發(fā)、硬物等進(jìn)入排污管,抽水馬桶內(nèi)不能倒其它雜物進(jìn)入,疏通下水道的費(fèi)用由乙方承擔(dān)。

  The outlet of bathtub, the shower, and the basin must be added special network to prevent the hair, hard things, etc. from getting into the pipeline. Mess and other things cannot be poured into the toilet bout. The fee for unchoking the sewer will be borne by Party B.

  6.5 日常損耗物品及維修由乙方承擔(dān)更換費(fèi)用(比如掛取窗簾、疏通下水道、換燈泡等) The normal wear & tear fees of the property shall be borne by Party B (Such as hanging and fetching curtains, unchoking the sewer, changing the bulb etc). 7)、乙方如長(zhǎng)期或經(jīng)常不在,乙方必須安排人員看管房屋,刮風(fēng)下雨時(shí)關(guān)好門窗,經(jīng)常通風(fēng)、開足空調(diào),還必須保證甲方及代理人能及時(shí)實(shí)施緊急和必要的維修修復(fù)工作,否則,造成的損失由乙方負(fù)責(zé)。

  If Party B is out regularly or for a long time, Party B must arrange someone to look after the leased property. Make sure the doors and the windows are closed when blowing and raining, often ventilate the house, run the air conditioner, and guarantee for Party A and the Agent to make implement urgent and essential maintenance. Otherwise, the losses caused should be borne by Party B.

  8.中介方義務(wù):Obligations of Intermediary

  1)督促雙方提供必要的證明文件,對(duì)出租方而言,需提供房產(chǎn)證(或者相關(guān)的證明性文件)及身份證復(fù)印件;對(duì)承租方而言,需提供身份證復(fù)印件或公司營(yíng)業(yè)執(zhí)照復(fù)印件。

  Supervision both sides provide the essential proof document, speaking of hires the side, must provide the real estate property card (or correlation certificate document) and the status card duplicate press work; Speaking of rents the side, must provide the status card duplicate press work or the company does business the license duplicate press work.

  2) 中介方提供的服務(wù)期與合同期一致

  The service of intermediary is available during the contract period.

  9.合同終止及解除的規(guī)定Termination and dissolution of the indenture

  1)、乙方在租賃期滿后如需續(xù)租,應(yīng)提前一個(gè)月通知甲方,由雙方另行協(xié)商續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權(quán)。在合同期內(nèi),甲乙雙方均不得擅自解除合同,如一方因故需解除合約,需提前一個(gè)月向另一方以書面形式提出終止請(qǐng)求,并賠償另一方相當(dāng)于一個(gè)月租金的違約金。如甲方提出終止請(qǐng)求,應(yīng)退回剩余的房屋租金給乙方。

  Within one month before the contract expires, Party B will notify Party A if it intends to extend the lease. In this situation, two parties will discuss matters over the extension. Under the same terms Party B has the priority to lease the premises. In contract period, both Party A and Paty B cannot relief this contract without authorization, if any one party needs to cancel this contract, this party must notify another party by writing at least one month before the intended termination, and this party must pay one months rent to another party as compensation. If Party A needs cancel this contract, Party A must return surplus rent which Party A was received to Party B.

  2)、本合同一經(jīng)雙方簽字后立即生效;未經(jīng)雙方同意,不得任意終止,如有未盡事宜,甲、乙雙方可另行協(xié)商。

  This contract will be effective after being signed by both parties. Any party has no right to terminate this contract without both party’s agreement. Anything not covered in this contract will be discussed separately by both parties.

  10、違約及處理Breach of the contract

  1)、甲、乙雙方任何一方在未征得對(duì)方諒解的情況下,不履行本合同規(guī)定條款,導(dǎo)致本合同中途終止,則視為該方違約,雙方同意違約金為 元整,若違約金不足彌補(bǔ)無(wú)過(guò)錯(cuò)方之損失,則違約方還需就不足部分支付賠償金。

  During the lease term, any party who fails to fulfill any article of this contract without the other party’s understanding will be deemed to breach the contract. Both parties agree that the default fine will be . In case the default fine is not sufficient to cover the loss suffered by the faultless party, the party in breach should pay additional compensation to the other party.

  2)、若雙方在執(zhí)行本合同或與本合同有關(guān)的事宜發(fā)生爭(zhēng)議,應(yīng)首先友好協(xié)商;協(xié)商不成,可向有管轄權(quán)的人民法院提起訴訟。

  Both parties will solve the disputes arising from execution of the contract or in connection with the contract through friendly consultation. In case the agreement cannot be reached, any party may submit the dispute to the court that has the jurisdiction over the matter.

  11、其他Miscellaneous

  1) 合同簽定之日,甲方按本合同月租金的100%,一次性向丙方支付中介信息服務(wù)費(fèi),即 元,大寫 .

  Party A will pay RMB ,100% rental of one month in this contract, to the Party C for the intermediate service on the day of signing the contract.
