1. Date of Employment
The Employee is employed with effect from 1st June 20xx.
2. Job Title
The position of the Employee is General Manager who reports to the Chairman of Directors of the Board or to the personnel of the mother company (or a sister company) appointed by the Chairman. The Employee’s duties may include but not necessarily be limited to sales and marketing activities, allocated by the Chairman.
3. Place of Work and Working Hours
The place of work may be located in an appointed office of the Company or the Employee may work at any other place agreed by both the Company and the Employee. The Employee may be required to make local and overseas travels occasionally in order to perform the duties.
The total number of working hours is 40 hours per week, excluding lunch / break. Working Hours: Weekdays 08:45 – 12:45, 14:00 – 18:00 (12:45 – 14:00 lunch / break) Weekends and Public Holidays: Off
4. Remuneration
The Employee’s monthly salary will be Salary??? with a twelfth month salary for a complete year of services, or pro-rated with the calendar year payable at the end of December.
The pay for the referred period will be deposited on the Employee’s bank account on the last weekday of the month. The Employee’s salary shall be annually reviewed and an adjustment of the salary, if any, will be made with effect from January 2012.
5. Mandatory Provident Fund
The Company will contribute five (5) % of the Employee’s basic salary as Mandatory
Provident Fund from 1st August 2011 on after the Employee’s probationary period for
2 months, but total fare will not exceed ??? per year.
6. Medical Insurance
The Employee’s medical insurance will be provided by the Company.
7. Holiday
The Company pays holiday allowance to an annual leave of twelve (12) days on
completion of each year’s service with the Company. The holiday is accrued during
the qualifying year, which is the calendar year, and can be held in the following
holiday year, which is from 1st June until 31st May the following year.
8. Termination
Termination terms for the both parties will be one (1) month’s written notice or
payment in lieu hereof.
9. Conflict of Interest
The Employee shall not engage, participate or be involved in any trades of businesses
which may be in conflict with the Company’s interests. The Employee is not allowed
to disclose information which will endanger the Company’s business to other parties
without consent and permission from authorized personnel of the Company.
The Employee will also undertake an obligation that should the Employee leave the
employ of the Company, the Employee will not, within a period of six (6) moths from
the date of the Employee’s leaving, engage himself or be engaged in activities which
directly or indirectly may compete with the activities of the Company. Should the
Employee, however, contrary to this obligation, thereby cause or lead to cause
increased competition for the Company, the Employee will agree to be liable for a
reasonable payment of compensation to the Company.
This Contract is executed in 2 original copies, of which one shall remain with the
Company whereas the other shall remain with the Employee.

一、合同內(nèi)容：
乙方的服務(wù)內(nèi)容：主要包括以下內(nèi)容
1、家務(wù);2、看護(hù)嬰兒;3、照看孩子;4、照顧老人(男、女);5、照顧老人(不能自理：男、女);6、看護(hù)病人(男、女);7、看護(hù)病人(半自理：男、女);8、看護(hù)病人(不能自理：男、女);9、醫(yī)院陪住;10、接送學(xué)生。

二、丙方的權(quán)利和義務(wù)
1、向甲方提供家庭服務(wù)員。建有家庭服務(wù)員輸送基地并保持經(jīng)常聯(lián)系，并保證家庭服務(wù)員來源明白、身份清楚、手續(xù)完備、身體健康。丙方已向甲方一次性收取家庭服務(wù)員手續(xù)費(fèi)共200元整。
2、丙方先收取甲方押金800元整。在家庭服務(wù)員服務(wù)期屆滿，甲方將家庭服務(wù)員安全送回丙方，并確認(rèn)家庭服務(wù)員服務(wù)期間內(nèi)的工資已結(jié)清及無其它勞務(wù)糾紛后，丙方如數(shù)把押金退還給甲方。
3、對甲方自愿贈給家庭服務(wù)員的衣物和預(yù)付的工資，屬雙方自愿行為，丙方不負(fù)責(zé)追回。丙方每月收取甲方家政服務(wù)務(wù)管理費(fèi)150元。
4、對新到的家庭服務(wù)員和服務(wù)員期滿回到公司的家庭服務(wù)員，丙方將視情況按期進(jìn)行職業(yè)道德教育和職業(yè)再培訓(xùn)，并重新安排上崗。
5、丙方應(yīng)負(fù)責(zé)乙方人員的專業(yè)培訓(xùn)，使其適合甲方的家庭需要。
6、丙方應(yīng)保證乙方的服務(wù)不得中斷。
三、甲方的權(quán)利和義務(wù)
1、及時按月付給家庭服務(wù)員足額的勞務(wù)工資_______元整。家庭服務(wù)員休息日每月不少于兩天，遇國家規(guī)定的節(jié)、假日，不能休息的，雙方協(xié)商，適當(dāng)加薪。不得拖欠或扣發(fā)家庭服務(wù)員的工資。
2、交納家庭服務(wù)員使用費(fèi)及手續(xù)費(fèi)后，一年內(nèi)免費(fèi)享有正常更換三次家庭服務(wù)員的機(jī)會。
3、向家庭服務(wù)員提供免費(fèi)正常食宿。不得安排其與異性成年人同居一室。并做到平等待人、不岐視、不虐待、保證家庭服務(wù)員服務(wù)期間人身、財產(chǎn)的安全。有義務(wù)對家庭服務(wù)員的家政服務(wù)工作進(jìn)行指導(dǎo)。
4、家庭服務(wù)員突發(fā)急病或其它傷害時，應(yīng)采取必要措施，治病救人。因從事合同規(guī)定的工作致傷，應(yīng)適當(dāng)負(fù)擔(dān)家庭服務(wù)員醫(yī)療、醫(yī)藥費(fèi)用。
5、不得強(qiáng)迫家庭服務(wù)員從事合同以外的工作，不得將家庭服務(wù)員帶往其它省市，不得私自將家庭服務(wù)員轉(zhuǎn)讓給他人服務(wù)。
6、有權(quán)要求和安排家庭服務(wù)員重新進(jìn)行體檢，如果體檢不合格，費(fèi)用由家庭服務(wù)員承擔(dān)，反之，由甲方承擔(dān)。
8、有權(quán)拒絕家庭服務(wù)員將同鄉(xiāng)、親友帶入家中。有權(quán)拒絕家庭服務(wù)員使用家中長途電話、電腦。
9、甲方家中手飾、珠寶、現(xiàn)金等貴重物品應(yīng)自行妥善保管。對家庭服務(wù)員因工作失誤造成的經(jīng)濟(jì)損失，應(yīng)同其協(xié)商解決或求助法律幫助。不得侵犯家庭服務(wù)員的人員權(quán)益。
10、發(fā)現(xiàn)家庭服務(wù)員患有不能勝任家政服務(wù)的疾病，應(yīng)及時將其送回丙方，并解除合同。
11、甲方如發(fā)現(xiàn)乙方有損害甲方權(quán)益的行為，或不勝任家政服務(wù)工作，甲方有權(quán)解除合同。
四、乙方的權(quán)利和責(zé)任
1、尊重和維護(hù)甲方、丙方的合法權(quán)利，自覺履行本合同規(guī)定的家政服務(wù)項(xiàng)目，熱誠服務(wù)。
2、享有按月、按時得到勞務(wù)工資的權(quán)利，每月休息日不少于兩天，如需加班，有權(quán)同甲方協(xié)商，增加工資。
3、有權(quán)拒絕甲方提出一切不合理的要求。有權(quán)維護(hù)自己的人身財產(chǎn)權(quán)利不受侵犯。
4 安心做好家政服務(wù)工作;如遇特殊情況(親屬患病、家有急事等)，需回家處理時，應(yīng)先征得甲方的同意并報丙方備案，履行請假或終止合同手續(xù)。不得擅自離崗。
5、不得擅自將親友及他人帶入甲方家中，不得隨便翻拿甲方家中物品，如有偷竊等違法行為，經(jīng)核實(shí)屬實(shí)，送有關(guān)部門依法處理。
6、不得參與甲方家庭及鄰糾紛，尊重甲方家的生活習(xí)慣，不得虐待所服務(wù)對象。
7、不得與其他家政服務(wù)人員惡意患通，損害甲、丙各方的合法權(quán)益。
8、合同期滿或中途解除合同，應(yīng)回丙方報到，等待丙方重新安排家政服務(wù)工作。如擅自離去，一切后果自負(fù)。
五、其它
1、簽定合同時，甲方應(yīng)按規(guī)定交納家庭服務(wù)員服務(wù)費(fèi)、手續(xù)費(fèi)。家庭服務(wù)員服務(wù)費(fèi)和手續(xù)費(fèi)一律不退。
2、合同期滿、合同內(nèi)容變更、終止等。甲方應(yīng)及時到丙方辦理相關(guān)手續(xù)。愿意繼續(xù)聘用原家庭服務(wù)員，請?jiān)?天內(nèi)到丙方簽定新一輪合同。如甲方與乙方私下達(dá)成服務(wù)協(xié)議，一但發(fā)生任何問題，丙方概不負(fù)責(zé)。并保留追究其責(zé)任的權(quán)利。
3、合同期未滿，單方要求解除合同，應(yīng)提前3天通知對方，無故要求解除合同的，應(yīng)由違約方交納違約金 元。合同執(zhí)行期間，如發(fā)生糾紛，應(yīng)先協(xié)商解決，協(xié)商不成可向法院提起民事訴訟。 本協(xié)議一式三份每方各執(zhí)一份簽字生效

第三條 乙方工作職責(zé)、事項(xiàng)由甲方依乙方的職務(wù)或工種，并視乙方能力及甲方需要進(jìn)行安排。
第四條 乙方的正常工作時間上午9：00至13:00、下午15：00至19：00，每周工作6天，周一至周六，周日休息。
第五條 甲方根據(jù)工作需要，要求乙方加班時，除不可抗拒的事由外，乙方應(yīng)予以配合。
第六條 由于乙方為提供勞務(wù)方，雙方不構(gòu)成勞動法律關(guān)系，所涉及到的乙方保險等與甲方無關(guān)。
第七條 甲方應(yīng)按月支付乙方報酬，乙方的工資待遇每月1500元人民幣，工作日包吃不包住。
第八條 乙方每月工資由甲方次月5日發(fā)放，若工資發(fā)放日適逢周日或假日，甲方可提前或推后1日或數(shù)日發(fā)放。
第九條 乙方不能勝任本合同時甲方有權(quán)隨時終止本合同，乙方發(fā)生的一切傷害事故由乙方自行承擔(dān)，甲方對此不負(fù)任何責(zé)任。
第十條 乙方應(yīng)盡職盡責(zé)，如果造成甲方經(jīng)濟(jì)損失或者其他損失，甲方終止本合同，并追究乙方的賠償責(zé)任
第十一條 乙方主動提出終止本合同時，需提前一個月通知甲方。 第十二條 本合同一式兩份，甲乙雙方各執(zhí)一份，經(jīng)雙方簽字后于月日起生效。
